Standard of Care

When a medical malpractice case is brought against a negligent nurse, a patient must meet the same elements as other malpractice cases. A patient must first prove a nurse-patient relationship was in place and that the nurse failed to meet the required standard of care. If the nurse(s) performed their job in a way that does not meet the standard of care (i.e. the way a competent nurse in a similar situation would have provided care), the nursing negligence led to injuries, and the patient suffered damages as a result, there may be a case for medical malpractice against the nurse(s) at issue.

Nursing Negligence

Nursing negligence and malpractice can occur in many different situations. One unfortunately common example is a nurse failing to closely monitor a patient in their care and thus failing to notice something of concern. As a result, the physician may not be timely notified of a changing condition, or be able to administer critical care. Nurses who injure the patient with medical equipment or commit a medication error can also be held liable for nursing negligence. Nurses are typically in charge of administering the proper medication to the patient, with the correct dosage and at the right time. Failing to do any of those things can cause injury to the patient.
